The website www.workinluxembourg.com (hereinafter referred as the “Website” or the “Site”) is is managed and developed by Luxinnovation GIE (hereinafter referred to as ‘Luxinnovation’ or “LXI” or ‘We’), registered with the Luxembourg Trade and Companies Register (RCSL) under number C16 and having its registered office at 5, avenue des Hauts Fourneaux L-4362 Esch-sur-Alzette.
Luxinnovation is responsible for the content of the Site: its design, graphic creation, development, maintenance, monitoring and availability.
The Site is published and hosted by Kentico Software CZ s.r.o., located at Nové sady 996/25 CZE-602 00 Brno, Czech Republic.
The host is Microsoft Ireland Operations via its Azure cloud services offering, whose registered office is at Carmanhall Road - Sandyford Business Estate - Dublin 18 - Ireland.
The Site, its information content and its services are made available free of charge and securely, using Internet technologies. If the User refuses, for any personal reason, not to accept the obligations of these GCU, he/she is invited not to use the Site.
Any Website User making use of the information, documents, and various services offered by the Site, is deemed to have read and accepted all the terms and notices of these Terms & Conditions. Other legal notices may interest you. We invite to read too our Privacy Policy and our Cookies Policy.
Using the Virtual Assistant (or Chatbot) implies acceptance of these Terms and Conditions of Use.
The objective of those Terms and Conditions are to be visible and accessible so the Website users (“The User”, or “You”) can easily learn the rules that apply to your navigation on our Site. This Terms & Conditions (“T&Cs”) are simple informative notices. The operation of the Site and the T&Cs are not binding on you.

DEFINITIONS
“Applicable Laws”: means all laws, regulations and other requirements applicable in the Grand Duchy of Luxembourg, as amended;
“Chatbot”: refers to the guided chat tool made available to the User instantly. Its purpose is to help the User find relevant information based on the questions asked, on the Site;
“Content”: Refers to any digital data in the form of text, video documents, images (animated and/or audio) accessible online by any User of the Site;
“Data Protection Laws” means any data protection law applicable in Luxembourg from time to time (including but not limited to the GDPR and the Luxembourg law of 1st August 2018 on the organization of the National Commission for Data Protection and the general regime on data protection, as may be amended or replaced);
“Force Majeure Event” means any unforeseeable, irresistible and exceptional condition or event beyond the Parties’ reasonable control which prevents the affected Party from performing its obligations under the Terms and Conditions in whole or in part, arising from acts, events, omissions or non-events beyond its reasonable control, including power outages, third party technical malfunctions, epidemic, pandemic, quarantine, riots, war, acts of terrorism, fire, flood, storm, or earthquake and any disaster;
“GDPR” means the Regulation n°2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data;
“Intellectual Property Rights” means, without limitation and where applicable, all present and future patents, utility models, ideas and rights to inventions (whether or not patentable or reduced to practice), improvements, all copyright and neighbouring rights (including without limitation moral rights, as well as the rights of reproduction, distribution, communication to the public, renting and lending), trademarks (whether registered and unregistered), service marks, rights in designs or models (whether registered or unregistered), brand names, product names, logos, slogans, trade names, company names and reputation, domain names, database right, rights in confidential and/or proprietary information (including without limitation know-how and trade secrets), rights in software (including without limitation algorithms, application programming interfaces, source, executable and object code, apparatus, circuit designs and assemblies), network configurations and architectures, concepts, marketing and development plans, methods and any other intellectual property rights, in each case whether registered or unregistered and including all applications for and renewals or extensions of such rights, and all similar or equivalent rights or forms of protection in any part of the world;
“Parties” means Luxinnovation, and the User;
“Personal data” : means any data relating to a natural person who can be identified directly or indirectly, by means of identification (name, job title, company or organization of affiliation, etc.) or contact details (e-mail address, among others);
“Services” refers to all content, information, features, and resources accessible from this Site, including links, redirects, or access to services provided by partners involved in the project. The Services may include features, tools, or information operated directly by Luxinnovation or by the partners of the Talent Attraction project, each acting under their own responsibility (please refer to section 4 of these T&C);
“User “: refers to any natural or legal person who consults the information on the Site and requests the services made available;
“Website”: refers to the Site where the content, information and services made available by the Consortium can be consulted, in the form of texts, images, videos, contact forms, legal notices, General Conditions of Use, Privacy Notice and other associated rights.
SUBJECT
The Site www.workinluxembourg.com aims to become the first point of entry for international talent interested in relocating to Luxembourg, by inspiring them and providing them with relevant basic information.
LINKS TO PARTNER SITES
The Talent Attraction website contains links and redirects to platforms operated by partners involved in the "Talent Attraction" project.
When you access these sites, you leave the area of responsibility of the operator of this website.
These sites are operated under the sole responsibility of their respective administrators, who define their own terms of use and data protection policies.
Luxinnovation cannot be held liable for the content, operation, or processing of your personal data on these third-party websites.
CHATBOT
The Virtual Assistant (or Chatbot) available on the Site offers a free-form writing mode. Therefore, the User may – knowingly or unknowingly – provide personal information, including sensitive data. The Virtual Assistant system is designed to minimize risk by blocking any possibility of processing (and therefore storing) personal data. Interactions are strictly anonymous.
Luxinnovation cannot guarantee the accuracy and completeness of the information provided by its Virtual Assistant (or Chatbot), nor its continuous proper functioning.
Luxinnovation strives to provide Site Users with the most relevant information based on their search criteria and the wording of their question(s). However, it cannot be held liable for any errors obtained.
OBLIGATIONS OF THE USER
Access to the Website is via Internet, User declares to know the risks and to accept them. He must protect himself against the effects of computer piracy by adopting an appropriate and secure computer configuration.
Luxinnovation can’t be held liable for any damage that the user may suffer directly or indirectly in connection with his navigation on this site and the use of its services as well as the Internet sites. to which it refers.
The User undertakes to act sincerely and fairly, in accordance with these Terms & Conditions.
The User undertakes not to send any messages via the contact form whose content is contrary to Luxembourg and European legislation and regulations, and/or of a defamatory, discriminatory or prejudicial nature on any grounds whatsoever.
The User is warned that Luxinnovation is free to take legal action in the event of flagrant contravention of these Terms and Conditions.
INTELLECTUAL PROPERTY
The Site and all its constituent elements (architecture, texts, titles, photographs, graphics, animations, sounds, images, illustrations, layout, etc.) are protected by intellectual property and copyright laws. Luxinnovation, under the supervision of the Ministry of the Economy and in consultation with its partners in the Talent Attraction project, grants no license or authorization relating to the intellectual property rights it holds on this Site, its elements, or the Services offered.
Reproduction of any Site content is permitted provided the source is expressly acknowledged. This content may not be sold or rented for a fee under any circumstances.
Users are only authorized to view, download, and print forms without prior authorization.
Any modification, transformation, or adaptation, in whole or in part, of the content is strictly prohibited.
Users who reproduce content from the portal agree not to use it in a manner contrary to human dignity and respect for the individual.
The rights implicitly or explicitly granted to you above constitute a license to use this Site and in no way a transfer of rights, ownership, or other rights relating to it.

Luxinnovation will best ensure maximum availability of this site. However, it cannot be held liable in the event of temporary partial or total unavailability of the site.

UNILATERAL RIGHT OF MODIFICATION
Luxinnovation reserves the right to modify unilaterally, at any time, all or part of the Site in particular in case of technical, legal or case-law developments or to implement of new functionalities. Luxinnovation may, for example, modify the visuals, graphic charts and other elements and/or contents at its sole discretion.
No liability for any direct or indirect damage in connection with such modifications can be held against Luxinnovation.
SEVERABILITY
Should any one condition of these Terms and Conditions become invalid, the validity of the other conditions will remain unaffected.
GOVERNING LAW AND JURISDICTION
Wherever the Site is used and/or consulted, these Terms and Conditions shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg.
The Parties irrevocably agree that any disputes arising out of or in connection with the Terms and Conditions shall be submitted exclusively to the courts of the City of Luxembourg, Grand Duchy of Luxembourg.
